These terms and conditions apply to the use of the ‘Design-a gifts’ website www.design-agifts.com and to the placement of an order by any method. Please do not continue to use the ‘Design-a gifts’ website or place an order if you do not agree with the following terms and conditions:

Please feel free to contact me by phone 07912 444 960 or by email zoe@design-agifts.com. I prefer my postal address to remain private until an order is placed. I then provide my postal address in an invoice.

YOUR CONTACT DETAILS
The only time I require your contact details is upon placing an order, to allow me to discuss your unique requirements. Any personal information imparted will NEVER be passed on to any third parties.

NEWSLETTER
By subscribing to my newsletter you permit me to send information about current special offers, new designs, website changes or events I may be attending. I will not pass your email to any third parties. To unsubscribe from the service please use the form on the newsletter page.

COPYRIGHT
All of the designs you see on my website are completely original works by me, Zoë Magee [unless otherwise stated].

PERMISSION TO USE MY DESIGNS
To copy and/or use any of my original designs you will require written permission from me [Zoë Magee]. To do this I first require you to phone me on 07912 444 960 to obtain my address. I then require you to state in writing who you are, why you want to use my work and where you propose to use it.

Permission, if granted, will be given in writing only. Any fees required to use my designs will be due immediately. Thank you for respecting my intellectual rights. Zoë Magee - March 2010.

PLACING AN ORDER
Orders can be placed in the following ways:

• By completing and submitting a form on the ‘Design-a gifts’ website
• By email: zoe@design-agifts.com
• By phone: 07912 444 960
• By completing an order form, found in selected retail outlets
• Through prior meeting arrangement
  

CIRCUMSTANCES WHERE I MAY NOT BE ABLE TO PROCEED WITH YOUR ORDER
If I cannot proceed with your order I will endeavour to notify you within 24 hours of the order having been placed. I will provide you with a reason, which will be one or more of the following:

• Where goods/materials are unavailable at the time of order
• Where I have not been given enough notice for a specific date
• If I'm required to recreate an existing character/celebrity/logo
• If your bespoke order is offensive in any way

CONFIRMING YOUR ORDER DETAILS
Initially I will confirm your order by phone. This is followed up with a 'Confirmation email', which provides written agreement of your bespoke order. I do not require you to reply to this email for me to proceed with your order.

CANCELLATIONS
In most circumstances it is your legal right to cancel an order within 7 working days of receiving the goods, however this is not the case with items that have been personalised and/or handcrafted to a customer's specific instructions.

I am afraid that I can only accept a cancellation if it is made within 24 hours of me sending your confirmation email. If an item is cancelled after this period, payment may still be owed.

If you do wish to cancel or change the design I would highly recommend you contact me via phone to notify me verbally of any alterations/cancellations. This is the best way to ensure immediate communication. If you do not contact me then I will assume the order details are correct and proceed with handcrafting your unique gift.

NON-PERSONALISED GIFTS
Non-personalised items [stated in description of item] can be cancelled within 7 working days of the order having been placed. To qualify for a refund you must return it in its original condition with its original packaging . Return postage is the responsibility of the customer.

DESCRIPTIVE INFORMATION
Great care has been taken to ensure the images of my designs and their descriptions are correct and that the colour reproduction is a good representation of the original items. Actual colours and design will vary slightly due to the handcrafted nature of ‘Design-a gifts’. All sizes are approximate and are for guidance only.

DEPOSIT
I currently do not require a deposit; instead I request full payment upon the gift being collected or a cheque prior to your gift being posted.

PAYMENT
I currently accept cash or cheques made payable to Zoë Magee. Full payment is required upon the item being collected or prior to the item being posted.

COMPLETION
I will contact you upon completion.

COLLECTION
If you have chosen to collect your item we will discuss an appropriate time and date.

POSTAL DELIVERY
If you have chosen to have your item delivered by post, the item will be posted to the address provided by the customer at the beginning of the process unless informed otherwise.

DAMAGE CAUSED DURING TRANSIT
It is my commitment to avoid damage during transit by packaging each item appropriately. I cannot be held responsible for any damage that occurs during transit. If damage should occur during transit please notify me immediately.

CAUTIONARY WARNING
Although polymer clay is durable and non-toxic, all handcrafted gifts must be handled with care and not given directly to small children. If broken, small pieces could become a choking hazard. Design-a gifts purchased for small children should be opened by an adult on the child’s behalf. Consideration must also be given to the placement of any gift which has small parts i.e. directly over a child’s cot would not be recommended.

RETURNS
I cannot accept returns or give refunds for any personalised, handcrafted ‘Design-a gift’. The only exception is if you were to feel the item does not conform to the original instructions. It is imperative that I am informed of your dissatisfaction within 7 working days of receiving the item.

If a refund is agreed, the item must be returned in its original condition with all original packaging to qualify. A refund will then be processed within 30 days.

Non-personalised items [stated in description of item] can be returned for a full refund within 14 days of purchase. You must return it in its original condition with all original packaging to qualify for a refund.

RETURNS ADVICE
I would advise my customers to obtain proof of purchase, or employ a ‘signed for’ and/or ‘insured’ postal method as I cannot be held responsible for the loss or damage of items being returned. In the event of a loss during transit upon returning an item, it will be the customer's responsibility to obtain compensation from the postal service employed.

All return postal costs are the responsibility of the customer. [Isle of Wight customers can return items personally or have them collected].

COMPLAINTS
If for any reason your shopping experience with me was unsatisfactory please contact me by phone 07912 444 960 or by email zoe@design-agifts or by post to the address found on your invoice and I promise to resolve your complaint to the best of my ability and as quickly as possible. If I have to alter my procedures as a result of your complaint I will do so immediately.

CARING FOR YOUR DESIGN-A GIFT
Accumulated dust can be gently removed using a soft bristle brush. Although water proof and colour fast it is usually advisable to keep the item out of direct sunlight and not directly under water. Design-a gifts are not toys.

AGREEMENT
If you have any queries regarding these terms and conditions you will need to contact me before you continue to use this website or place an order. If you do not, then I will take it as a sign of your agreement of these terms and conditions. Thank you, Zoë Magee.

DISCLAIMER
I cannot accept any responsibility whatsoever for any death or injury caused by any items purchased, however incurred.
